Terms of Service

Company: 360immerse Inc.

 

By commissioning services from 360immerse Inc., you (“the Client”) agree to the following Terms of Service.

  1. Services

360immerse Inc. provides real estate media services including, but not limited to, photography, videography, drone imaging, 3D tours (Matterport), floorplans, and related digital media (“Deliverables”).

Deliverables are provided for marketing and promotional purposes unless otherwise specified in writing.

  1. Payments & Fees
  • Standard Payment Terms: Full payment is due upon delivery of media unless otherwise agreed in writing. Deliverables will not be released until payment is received in full.
  • Travel Fee: A mileage charge of $0.72/km applies for all travel outside the Winnipeg Perimeter Highway. Distance is calculated as round-trip from the Perimeter boundary to the project site and back.
  • Late Payments: Invoices not paid within 30 days of delivery may be subject to late fees or interest charges of 2% per month (24% annually).
  1. Client Responsibilities
  • The Client is responsible for ensuring that properties are prepared and accessible at the scheduled service time.
  • If a property is not ready or accessible, rescheduling fees may apply.
  1. Intellectual Property & Usage Rights
  • Ownership: 360immerse Inc. retains full copyright ownership of all Deliverables until payment is received in full.
  • License to Use: Upon payment, the Client is granted a non-exclusive, non-transferable license to use Deliverables for marketing and promotional purposes related to the listed property.
  • Restrictions: Deliverables may not be resold, transferred, or reused for purposes beyond the original project without written consent.
  1. Matterport Services Disclaimer

360immerse Inc. provides Matterport 3D tours, floorplans, and related assets using the Matterport Pro3 system.

  • Permitted Uses: Deliverables may be used for real estate marketing and, at the Client’s discretion, as reference material in construction, architecture, or design projects.
  • Accuracy Disclaimer: While the Matterport Pro3 offers advanced scanning technology, all measurements and data are approximate. For regulated or critical applications (e.g., construction, CAD drawings, BIM modeling, permits), Clients must verify accuracy independently or through licensed professionals.
  • Limitation of Liability: 360immerse Inc. assumes no liability for errors, omissions, or inaccuracies if Matterport outputs are used for purposes beyond marketing. The Client accepts all risks associated with such use.
  1. Limitation of Liability
  • Deliverables are provided “as-is.”
  • 360immerse Inc. will not be held responsible for indirect, incidental, or consequential damages arising from the use of Deliverables.
  • In all cases, liability is limited to the amount paid for the specific services rendered.
  1. Termination

360immerse Inc. reserves the right to refuse, suspend, or terminate services if the Client fails to comply with these Terms.

  1. Governing Law

These Terms are governed by the laws of the Province of Manitoba, Canada. Any disputes will be resolved within the courts of Manitoba.
